Terms of Service

NewOwnerIQ is a software service that monitors public county property records for ownership changes on addresses you upload, and helps you send personalized retention postcards to new homeowners. By creating an account or using the service, you agree to these terms.

If you don't agree with any part, don't use the service.

You're responsible for keeping your password and 2FA codes safe. Every action taken from a logged-in session is treated as authorized by you. We'll do our best to alert you when something looks suspicious (new-device emails, breach detection) but you remain accountable.

You must be 18 or older and authorized to bind the business you sign up. One person per account — sharing logins violates these terms and breaks the audit trail.

Sending retention postcards to new owners of homes you previously serviced and have registered with us. Examples: landscaping, HVAC, pest control, pool service, AV/networking, plumbing, cleaning, generator service, painting, construction, metal work.

What you can't use it for:

• Sending political mail, fundraising solicitations, religious appeals, or content unrelated to home services
• Stalking, harassment, or any communication a reasonable recipient would experience as intimidating
• Bulk advertising to addresses you have no legitimate prior service relationship with — this is a retention tool, not a cold prospecting platform
• Bypassing or stress-testing our rate limits, security controls, or county-API quotas
• Reverse-engineering the platform for the purpose of building a competing service
• Anything illegal under federal, Alabama state, or applicable local law

We reserve the right to suspend or terminate accounts that violate these rules. We'll generally email before terminating, except for cases involving fraud, abuse, or active security threats.

Plans and per-mailer pricing are published at /pricing. Pro is $19/month. Postcards are billed per send: 4×6 at $3.50, 6×9 at $4.95, 6×11 at $6.95.

Subscription billing runs through Stripe. We never see your card data. You can cancel Pro at any time from /settings/plan — your access continues through the current paid period. Pro features stop at the end of that period; no pro-rated refund.

Mailer charges are captured at the moment you click Approve. Once a postcard is handed to the print provider it cannot be unsent or refunded.

If a charge fails, we'll mark your subscription past_due and email you. You have 30 days to resolve it. After that, the subscription is canceled automatically and your account drops to Free.

We aim for high availability but make no formal SLA on the Free or Pro tier. Enterprise contracts can include an explicit SLA — contact hello@newowneriq.com for terms.

We rely on county tax-assessor APIs we don't control. When they're down or change their schemas, monitoring may pause. We'll surface status at /admin/health (operator view) and email you on extended outages where appropriate.

With your explicit opt-in, we may share that you previously serviced a specific address with verified real estate professionals so they can introduce you to the new owner when the home changes hands. The realtor only sees: your business name, service category, and the fact that you serviced that address.

We never share service notes, customer names, sale prices, internal pricing, or anything beyond “this contractor serviced this address.” You can opt in or out at any time in your settings; opt-in is off by default and required before any sharing happens. Real estate professionals are verified via state license-database lookup (in Alabama: the Alabama Real Estate Commission).

You retain ownership of everything you upload: property lists, customer names, mailer copy, business profile. By using the service you grant us a limited license to process that data solely to deliver the service to you (display in the app, render onto postcards, send via the print provider, store in our database).

We own the application, the marketing site, our brand and trademarks, and the underlying software. You don't get a license to copy or redistribute any of it.

AI-generated postcard copy: when you click "Generate" in the Pro copy editor, your business profile and property context are sent to Anthropic's API to produce a copy suggestion. You retain the copyright on copy you accept and edit; we make no claim. Anthropic's terms apply to that data leaving our system.

You are the sender of record on every postcard. Postcards are physical mail and are not covered by the CAN-SPAM Act (which is email). They're also not subject to TCPA (which is calls/SMS). They are subject to standard postal regulations.

If a recipient asks you to stop mailing them, you must honor it. We surface a "requested unsubscribe" mechanism for leads you capture; you're responsible for not re-targeting addresses you've been asked to leave alone.

The service is provided "as is." We don't warrant that ownership-change detection is 100% accurate (county records can lag months behind real-world transactions), that postcards will always deliver (USPS happens), or that the service will be uninterrupted. Use your judgment before sending mail off our data.

To the extent permitted by law, our total liability under these terms is capped at the amount you've paid us in the 12 months before the claim. We're not liable for indirect, consequential, lost-profits, or punitive damages.

You can delete your account at any time from /settings/account — see the Privacy Policy for what gets removed.

We can suspend or terminate accounts that violate these terms. If we terminate without cause we'll refund any unused subscription portion pro-rata.

These terms are governed by the laws of the State of Alabama, USA. Any dispute will be resolved in the state or federal courts located in Jefferson County, Alabama.

When we materially change these terms we'll update the "Last updated" date and email account holders. Continued use after the change means you accept the new version. If you don't accept, delete your account before continuing.
